Pool, Terrace Glazing or Solar in Murcia: How Permission Works

Making your Murcia home your own is straightforward. The town hall approves the works through one of three routes, and on a resort the community of owners agrees anything that changes the outside of the building. Solar panels are the easiest of all: Spanish law needs only a one-third vote in the community.

One of the things buyers enjoy most after the keys are handed over is making the place theirs. A private plunge pool, a glazed terrace for winter evenings, solar panels on the roof to help power the air conditioning on sunny days. All of these are common on Murcia's golf resorts, and the permission process is well trodden.

Who gives permission for home improvements in Murcia?

Two bodies are involved, and they each look at different things.

  • The town hall (ayuntamiento) approves the building works themselves.
  • Your community of owners (comunidad de propietarios) agrees anything that affects shared parts of the resort or the look of the building.

On a detached villa with its own plot and roof, most decisions are yours plus the town hall. On an apartment or townhouse, the community is part of the conversation too. I'd suggest speaking to the community first, then the town hall. Your community administrator can tell you how to put a request to the next meeting.

What are the three town hall permission routes in Murcia?

The Region of Murcia's planning law, Ley 13/2015, sets out three routes, depending on the size of the job.

RouteWhat it's forHow it works
Licencia urbanísticaNew construction, structural changes, changes to the exterior of the buildingPrior approval from the town hall, usually with an architect's project
Declaración responsablePartial reforms that don't need a full project, renewing installationsYou file a declaration and can proceed, subject to town hall checks
Comunicación previaMinor repairs, decoration, small worksYou notify the town hall

Each town hall has its own ordinance, fees and ICIO (the local construction tax). The resorts where MedSol sells fall under different municipalities, including Murcia, Alhama de Murcia and Torre Pacheco, so check the specific rules with the local planning office or a local architect.

How do I get permission for a private pool?

A private pool is usually treated as a full licencia urbanística. A local architect prepares the project, which covers the design, structural and installation calculations, health and safety, quality control and waste management. The architect submits it, and you pay the licence fees, the ICIO and a small waste-management deposit.

That sounds like a lot of documents, but it's routine work for architects on the Costa Cálida, and most pool builders work with one they know. On a resort, check the community's rules too, as some set out where pools can go or how fencing should look.

Can I glaze my terrace?

Many owners do, because a glazed terrace gives you an extra sunny room for the cooler months from November to February.

Because glazing changes the outside of the building, it usually needs a licencia from the town hall and the agreement of the community. On a resort, the façade and often the terrace surface are shared elements under the Ley de Propiedad Horizontal, even when the terrace is yours to use.

The good news is that many communities have already agreed a standard design, such as a particular frameless glass system or frame colour. If yours has one, following it makes approval much simpler and keeps the whole resort looking consistent, which protects everyone's values.

How easy is it to add solar panels?

This is the simplest of the three, and Spanish law is firmly on your side.

Under Article 17.1 of the Ley de Propiedad Horizontal, installing renewable-energy systems in a community, including solar and aerothermal systems, needs the approval of just one third of owners representing one third of the participation quotas. You don't need a majority. Owners who voted against can't be charged for the installation unless they later ask to use it.

With your own roof on a detached villa, it's your decision plus the town hall, and solar is generally handled by a declaración responsable rather than a full licence.

Murcia has more than enough sunshine to make solar worthwhile, and it pairs well with air conditioning in summer. If you're a Spanish tax resident, ask your adviser about any energy-efficiency tax deductions available at the time; they apply to Spanish income tax, so non-resident owners should plan without them.

What about air conditioning and windows?

  • Air conditioning. Usually a declaración responsable or comunicación previa. If the outdoor unit goes on the façade or a shared roof, ask the community where units should be placed. Many resorts have a standard position.
  • Replacing windows. Like-for-like replacements are usually a comunicación previa or declaración responsable. Enlarging or moving an opening becomes a licencia.

Can I add extras while my new-build home is being built?

Often, yes, and it's the easiest way to do it. On a new build, ask the developer early whether a private pool, solar panels, pre-installed air conditioning or terrace options are available. If they are, the work is designed in and covered by the project's own licence, and you move in with it finished.

If an option isn't offered, knowing the rules above means you can plan it for after completion. Because we know every development we sell on, we can tell you which extras each one offers and compare them for you before you reserve.

FAQ

Do I need a licence to build a pool in Murcia?

Usually, yes. A private pool is generally a full licencia urbanística, with a project prepared by a local architect and the town hall's fees and ICIO construction tax.

Can I glaze my terrace on a Murcia resort?

Usually, with a town hall licence and the community's agreement, because glazing changes the exterior. Many communities have an approved standard design that makes it straightforward.

What vote do I need to install solar panels in a Spanish community?

One third of owners representing one third of participation quotas, under Article 17.1 of the Ley de Propiedad Horizontal. Owners who vote against aren't charged unless they later use it.

What are the three types of building permission in Murcia?

Under Ley 13/2015: licencia urbanística for major and exterior works, declaración responsable for partial reforms, and comunicación previa for minor repairs and decoration.

Are the rules the same in every Murcia town?

The three routes apply across the region, but each town hall sets its own ordinance, fees and ICIO. Check with the local planning office for your resort.
